Arbitration Clause

Also called: mandatory arbitration, class action waiver

An arbitration clause requires disputes to go to private arbitration rather than court, usually paired with a waiver of class actions. Nearly every US brokerage and card agreement contains one. Arbitration is faster and cheaper per case and produces no public record or precedent, and the class waiver removes the mechanism that makes small claims viable at all.
